어쩌다 동네 아는 형의 친구분 상담하면서 또 한번 느껴서 쓸데없는 글 올려 보려고. 먼저 3줄 요약 하면 1. 지주택(지역주택조합)은 뒤져도 하지 말자 2. 1번 원칙을 지키자 3. 2번 원칙을 지키자 정도로 요약할 수 있네. 진짜 절때, 절때 하지마.... 절때로 하지마 제발... 지역주택 조합 아파트가 너무 위치가 좋아서 들어가고 싶다고? 그럼 일반분양 받거나, 착공 이후에 입주권을 프리미엄 주고 사...... 몇억 얹어서 주는거 비싸보이는데, 여튼 그러면 글 좀 읽어봐. 그럼 시작할게! 동네 돌아다니다 보면 이런 현수막 볼 수 있을거야 인터넷에서 퍼온건데, 정말 말도 안되는 소리지 ㅋㅋ 평당 건축비가 요즘 브랜드 아파트의 경우, 900만원에 육박하는 세상이야. 땅값 빼고, 철근 시멘트 값만 ㅋㅋ 근데 분양가가 평당700? 어림없는 소리지. 뭐 이런 가격 부분은 둘째 치고, 일단 결론부터 말하면 지역주택조합은 그냥 사기야. 저 가격에 아파트를 지을 수 없는건 당연해. 추가분담금을 더 내는건 기본이고, 추분을 내도 보통은 아파트를 안짓거나 못지어. 아니면 10년 후에 지어줘. 이 내용을 오늘 상담(사실 술주정 받은)사례를 들어서 설명해줄게. 설명 전에 지주택이 뭐냐면, 일반적으로 새 아파트를 사는 방법은 크게 3가지가 있어. 1. 누가 지은 아파트를 산다(민간분양) 2. 국가에서 지은 아파트를 산다(공공분양) 3. 내가 직접 아파트를 짓는다(지역주택조합) 이 3번이 지역주택조합 사업인거야. 그니까, 지역주택조합 모델하우스에 가서 니가 계약한 건, 아파트를 사는 계약서를 쓴게 아냐! 아파트를 우리끼리 돈 모아서 지을건데, 거기 모임에 가입을 한 거지. 근데 생각해보자. 내가 그 복잡한 주택법과 건축법을 잘 알까? 같이 가입한 옆집 철수가 이걸 알까? 당연히 몰라. 엄청 복잡하고 귀찮고 어려운 부분이니까. 그래서 보통 [업무대행사] 라는 지들딴에 전문가를 끼고, 또, 이 업무대행사를 감시하기 위해서 일할 사람을 모아. 이걸 [지역주택조합 조합장과 사무원] 이라 해. 우리 조합원들중에 몇명 똘똘한 사람들을 선정하는거지.  그리고 여기서(시작부터) 문제가 발생해.  사례를 보면서 왜 그런지 보자. 1. 사업의 시작 2015년, 수도권 모 도시에서 지역주택조합 참여자를 모아. 시세대비 저렴한 가격과 빠른 시공을 장담하며, 총 1200명의 조합원에게 가입비 500만원씩을 요구하지. [조합 잔고: 1200명 x 5,000,000 = 60억] 500을 낸 조합원: 와! 이제 이 돈을 가지고, 조합원이 모였으니 건설사를 선정하고, 땅을 사겠지? 금방 새 집 생기는건가? - 응 아니야~ 아직 땅 하나도 안샀어~ 뭔소리야? 설명들을때 이미 계약서 다 받았다던데? 그럼 산거 아님? 지주택에서 제시한 그 계약서는 토지사용승낙서 란 서류야. 토지매매 계약서가 아니야! 아직 토지주들한테 땅을 산게 아니야. "사업이 시작되면, 땅을 너가 써도 괜찮아." 정도의 의미를 가진 서류로, 인허가 관련해서 필요한 서류긴 해. 하지만 가장 큰건, 저건 땅을 사온게 아니야. 진짜 건물을 지으려면 땅을 조합에서 사야하는데, 매매가도 정해진 것 없고, 이전이나 매매 일자도 정해진 것 아무것도 없기 때문에, 만일 사용승낙을 받은 지주가 깽판을 지기 시작하면 아주아주 골치가 아파져. 물론 저거라도 받아놓았으면 좋아. 어차피 나중에 받아야 하거든. 근데 저거 조차 속이는 조합이 100%야. 이제까지 본 모든 사례들 중에, 저거 가지고  장난질 안한 조합은 본 적 없음. 안받고 방문 해서 이야기 한번 나눠본 집도 조합홍보할때 그냥 승낙받은 집인척 은근슬쩍 끼워넣음. 여튼 넘어가자 일단은. 헤헤 안녕하세요. 저는 조합장이자 업무대행사입니다.[이하 도둑놈으로 표기] (사실 조합장과 업무대행사는 다른 사람이지만 그냥 같은 놈으로 취급할게요.) 여튼 우리가 토지사용 승낙도 받고, 인허가도 앞으로 할게 많아요 ㅎㅎ 월급이랑 사무실 비용 조합비 모인거에서 가져갈게요 ㅎㅎ System: [앞으로 조합장 및 직원 3인 및 업무대행비 매달 40,000,000만원씩  발생합니다.] 조합원 : 비싼거 같긴 한데... 뭐 어쩔수 없다. 빨리좀 싸게 싸게 지어주쇼 그렇게 1년 후.... 조합원 : 왜 소식이 없냐? 하긴 한다는게 맞는가? 우체국: 우편이요~ 조합원 : 어? 조합에서 뭐가 날라왔네? 뭔 내용이지? 도둑놈: [조합은행잔고: 10억, 50억 이미 해먹음] 안녕하세요 추운 겨울 잘 보내시나요? 저희가 열심히 업무를 추진하고 있어요 이제 우리가 조합설립인가를 준비 중인데, 이렇게 하려면 토지의 15%를 사야합니다. 근데 토지주들 저항이 거세네요 ㅠㅠ [어쩌구 저쩌구 a4 4장 분량의 개소리] 그래서 결론을 말씀드리면, 조합원 분들의 자서 가 필요합니다! 별건 아니니깐 첨부양식 읽어보시고 싸인해서 보내면 됩니다 ㅎ 이건 당연히 필요한 절차니까 꼭 해주세요! 안하면 우리 조합 망할수도 있거나, 아니면 나중에 집 안줄수도 있어요! 조심하셈 ㅎㅎ 조합원 : 자서가 뭐지? 은행대출? 뭐 내가 빌리는게 아니니깐 뭐 지들이 알아서 갚겠지... System : 조합잔고에 추가로 300억이 생겼습니다!  설명충 작성자 : 방금 조합원은 연대보증을 섰어! 우와!!!! 무려 2천 5백만원씩 1200명, 총액 300억짜리 연대보증! 이런 일은 거의 일어나지 않지만, 진짜 재수없으면 아파트도 못받고 저거 600억 니가 그대로 갚아야해! 진짜로! 저거 보증이야 보증!  위 도둑놈의 말을 풀어 설명하자면, 지금 땅을 사려고 하는데, 땅 살 돈이 없으니 조합원들에게 신용대출을 요구한 내용이야! 그리고 이텔릭, 빨간글씨, 큰글자로 강조한 저 [자서] 란 글씨는 아주 간단한 약어인데 [자필서명] 의 약자야. 이걸 왜 도둑놈이 자서라 부르냐면 조합원들이 자필서명을 했다는걸 모르게 하려고 일부로 쓰는거야. 계속 자서, 자서 이런식으로 부르면서 햇갈리게 만드는거지. 악질적인 방법이고, 기만적인 방법이야.  물론 저 돈이 실제로 필요할거야. 왜냐면 저 사람들 말대로 땅을 사긴 해야 할테니까. 근데 정말, 제값주고 땅을 사올까? 도둑놈(업무대행사): 아이고 내 사촌동생...아니지 지주님 반갑습니다 ㅎㅎ 땅을 파셔야죠? 얼마까지 생각하시나요? 지주: 아 형 ㅎㅎ이 아니고 사장님 반갑습니다~ 제가 이 땅에 대해 애착(작년에 샀음)이 많고, 농사를 지으려(농취층 받고 농사 지은적 없음)고 산거라 ㅎㅎ 또, 제가 비싸게(작년에 경매로 평당 15만원에 낙찰받음) 산 땅이라 고민이 많네요 ㅎㅎㅎㅎ 도둑놈: 아휴 그럼요~ 저희가 다 보상해드려야죠. 평당 700만원(대신 나중에 챙겨줘)에 사 드릴게요. 어떻습니까? 지주: 아... 좀 아쉬운데...(존나 만족하는 가격이지만) 좀 더 고민을 해봐야 할 것(시간을 더 끌어서 형이 지역조합으로 부터 월급을 더 오랜기간 받야아 한다) 같네요 ㅎㅎ  3달 있다 보시죠? 도둑놈: 아 예~ 그러시죠~ 이 지랄을 보통 1년은 해. 절때로, 지역주택조합에서 토지 매입 과정은 순탄하게 흘거가고, 정의롭게 흘러가지 않아 99%의 케이스는 이런 일이 일어나거나 더 심하게 일어나. 그리고 저런걸로만 빼먹는게 아니야 또 다른 예시를 볼까? 도둑놈: 어디보자~ 이거 공사 하려면 땅 면적 계산이 필요하네? 측량사 부릅시다. 야 동생아~ 어디 가서 그 측량관련 면허좀 사와라~. 응~ 알았어. 이제부터 난 측량사무소 사장~ 히히 도둑놈: 아이고 사장님 반갑습니다~ 측량 좀 해주시죠? 도둑동생: 예~ 당연하죠~ 견적을 내 보니깐, 직원이 10명 필요하고(실제 4명도 안감) 기간은 2달(보름도 안하고 나머진 놀꺼임) 걸리니까 대충 15억(평균 비용의 2배) 주세요~ 싸게 해 드린겁니다.(나중에 룸으로 술먹으러 가면 싸게 해 주겠다) 도둑놈: 아우 당연하죠~현금 쿨하게 쏩니다! 또 1년 후... 조합원 : 하 씨발 2년이 지났는데 아무 소식이 왜 없지. 나 당한건가? 우체국: 우편이요~ 조합원 : 또 뭐야? 도둑놈: [조합은행잔고: 120억, (240억은 떡사먹음)] 고생이 많으십니다~ 관련 민원 어쩌구 저쩌고(토지주들 나쁘다 어쩌구 저쩌구 해서 밀렸고, 공무원 등등 그냥 핑계) 결국 거의 다 왔습니다! 시공승인도 받을거고, 이제 거의 다 왔는데, PF 받기 전, 추가 브릿지 대출이 필요합니다! 자서 한번 더 쓰세요! 우리가 다 해줍니다! 이자는 조합에서 부담합니다! 거하게 양보합니다! 조합원 : 뭔진 모르겠지만...... 거의 다 왔단거겠지? 그래 쓰자... 뭐 이자도 저쪽에서 낸다고 하니까. (진짜임) 우린 잘못 없어요! 소송합시다! 도둑놈: 아이고 저 양심없는것들 ㅠㅠ 그래서 소송하는 기간동안 여러분들을 기다리게 할 순 없으니 새로 설계사무소 선정하고 계획 수정도 하겠습니다. 좀만 기다려 주세요 ㅠㅠㅠㅠ 그리고 이 책임을 지는 의미에서 전 조합장에서 사퇴합니다ㅠㅠ 후임은 투표를 통해(조작해서 후배한테 줄거임) 결정합니다. 다들 성투하세요! ??? : 반갑습니다~ 공정한 선거를 통해 당선된 김 대식 입니다~ 그 뭐냐~ 지방에서 사업(깡패)을 했고요~ 인생 모토는 앞만 보고 살자!(나는 빠꾸가 없는 인생임을 강조) 입니다! 잘 해 봅시다! 또 2년 후 조합원 : 시발 더이상 참을수 없다! 조합장 나와 씨발! 무서워서 참는것도 하루,이틀이지 못하겠다! 내가 주도한다! 더이상 못참아! 대식씨: 어이구야~ 이제마이 오셨구만~ 근데 우짠댜? 이미 다 써버렸으~ 그 서류쓴거 보시면 알겠지만~ 우린 다 적법하게 썼어~ 나가고 싶으면 돌려받을건 돈은 없고, 아까 그 뭐시기냐 브릿지 대출? 그거랑 이전에 받은거 해서 1억 갚고 나가셔~ 뭐 꼽냐? 왜 눈을 그렇게 뜰까? 한대 치게? 조합원 : 헛소리 하지 마! 소송 드간다! 일단 너 배임횡령으로 고소! 꼭 내 돈 돌려받거나 건물로 받는다! 대식씨: 그래 ㅋㅋ 그래라~ 그거 소송기간동안 난 월급 다 빨아먹고 빨아먹을거 다 빨아먹을란다 ㅋㅋㅋ 열심히 변호사 사서 해 보셔~ 아! 그리고 질질 끌어야 월급을 더 받으니깐 익명 아이디 하나 만들어서 카페에서 분탕쳐야지~ 누군지 알거같은 익명유저1: 님들 그거 하심? 지금 막 갑자기 나와서 주도하는 김개붕씨 뭔가 수상하지 않음? 이제까지 가만히 있다 왜... 글고 듣기론 지금 진행 잘 되고 있는거 같은데 저분때매 또 입주 늦어진다네요 ㅜㅜㅜㅜ 누군지 알거같은 익명유저2: 2222222 33333333 ㄹㅇ 그런거 아님? ㄹㅇ 나쁜 사람 참 많아 조합원 : 시발롬들아!!!!!! 이제까지 본 사람들이라면 다 이해하겠지만 업무대행사와 조합측 이사진은 절때로, 공사를 끝내려고 하지 않아! 왜냐면 그렇게 기간이 길어야지 월급을 빨아먹는 기간이 길어지고, 기간이 길면 길수록 적은 액수로 천천히 오랫동안 횡령을 할 수 있거든. 이렇게 오랜 기간 각종 잡비로 횡령을 해야 나중에 고소를 당하고 형사로 넘어가도 죄로 인정받기가 어려지니깐. 글고 제일 큰건 대식씨가 한 말은 일부 맞는 말이야. 횡령을 했다면 잘못인데, 개붕이가 적어준 서류로 대출을 받은거고 업무를 진행하며 비용이 발생한거야. 애초에 그 큰 돈을 무책임하게 넘겨준 본인의 잘못이 엄청 커. 그렇기 때문에, 소송을 하더라도 아주 어렵고 복잡한 길 뿐 만 남은게 당연한거고. 일단 계속 보자 [1년간의 소송을 진행하고...] 법원: 에... 저기 그 뭐냐 대식씨가 잘못한거 같네요. 근데 일을 안한건 또 아니고, 이게 형법상 사기라 보긴 또 증거가 없네요. 그래도 일단 일부 책임 있으니깐 조금은 보상 하세요 그럼 이만~ 대식: ㅋㅋㅋㅋㅋ응 난 신불자야~ 만세부를거야~ 그럼 이만 꺼억~ 잘 먹고 갑니다~ 조합원 : 저새끼 저럴줄 알았어... 저놈은 나중에 조지고(조질 방법 현실적으로 없음) 일단 아파트부터 어케 해 보자,.... 통장 잔고가 얼마있지? 은행님 조합 통장에 돈 얼마 남아 있어요? 은행: 잠시만요... 이거 통장이 한두개가 아니라서... 아이구 다 찾아보니깐 지금 어.... 400... 개붕이: 예? 400억이요? 내가 대출해준거랑 낸게 600억이 넘는데요? 아이구 저놈들 많이도 해 먹었네...  은행: 아뇨 빚만 400억입니다 ^^ 지금 통장에 현금은 20억 정도 있고, 기존 대출금이랑 이자 다 합치니까 400억정도 있네요. 토탈 -380억 갚으셔야 합니다 ㅎㅎ 이율은 7%인거 아시죠? 빨리 갚아주세요 ㅎㅎㅎ (할 말 잃음) 여기까지가 딱 내 지인의 사례야. 세부적인 액수나 절차는 틀릴 수 있어. 물론 저 돈만 남은건 아니고, 일부 사업부지 토지도 사 둔게 있고, 전 시행사랑 조합장에 대한 고소고발도 진행중이지. 하지만 그래도 결국엔, 아마 이 아파트는 짓기 정말 어려울거고, 짓는다 해도 아마 조합원 1인당 추가분담금을 최소 1억 이상은 내야 할 것이고, 소송도 아직 많이 남았기 때문에 힘든 싸움을 수년간 더 해야할 상황인거지. 다행인 것은 5년 전에 비해서 아파트 가격이 많이 올랐고, 조합에 이미 땅은 거의 모여있다는게 정말 다행인 부분이야. 추가분담금이 나온다 하더라도, 아파트를 시세보다 조금은 더 싸게 지을 순 있을테니까. 하지만 지금 막, 지역주택조합을 찾아보는 개붕이라면? 또, 앞으로 아파트 가격이 조금씩 빠진다면? 정말, 말도 안되는 상황이 벌어지겠지? 여튼 길이 길었는데 그냥 하지마 씨발. 여튼 하지마 3줄요약 1. 지주택 다 사기니까 하지 마셈 2. 근데 나름 적법한 절차를 거치기도 하고, 기간도 길고 피해자도 많아서 사기 입증이 힘듬. 그래서 처벌도 안받음 보통 3. 그러니까 제발 하지 마셈 출처 실제 지주택 성공률은 7-8프로 정도밖에 안 되고 추가 분담금 내서 완공하는 게 또 그 정도, 나머지 85프로는 사기꾼이니까 아예 지주택에는 발을 들이지도 말자는 말 ㅇㅋ?

재건축된 30억 아파트에서 나던 악취의 정체
